Cameroon/Fecafoot : The Tombi A Roko case already at the Swiss Federal Court,


Decidedly, the president of the Cameroonian Football Federation (Fecafoot), Tombi a Roko Sidiki is the object of a real persecution on the part of its patented opponents. After a period of relative calm, they recovered from the beast by launching a phase of bold legal battles. As in a choreographic movement, all the belligerent factions set themselves up in order of battle to decisively strike with their common enemy.

After Abdouraman Hamadou appealed to the Swiss Federal Tribunal, weary of the tribulations suffered at the level of the Court of Arbitration for Sport (CAS), John Begheni Ndeh, first vice-president of the federal executive of 2009 followed suit.
Already, on March 24, 2017, eight members of the Association of Amateur Football Clubs of Cameroon (Acfac) wrote to Gianni Infantino, President of FIFA. From this correspondence, it appears that the Acfac expressly requests: First: The confirmation of the sentence of the Chamber of Conciliation and Arbitration (Cca) of the National Olympic and Sports Committee of Cameroon of 12 November 2015 which pronounced the cancellation Of the Fecafoot elections, to be held in 2015.
Secondly: That those who violated the statutes of Fecafoot, Caf and Fifa, usurping the functions are sanctioned in relation to the disciplinary code of the Fifa article 64. Tercio: That on the basis of art 29 of the electoral code of the Fecafoot on the continuity of service "the General Assembly of Fecafoot, the Assemblies of the regional and divisiona leagues will continue to exercise their functions until finalization of the electoral procedure".
Here is an excerpt from Fifa's reply: "... Mr Véron Mosengo Omba, Director of Member Associations Africa and the Caribbean, will contact Fecafoot and other interested parties to present the actions that the Fifa plans to undertake to overcome this situation ". This almost skewed response, from Fatima Samoura, secretary general of FIFA, shows in reality, that there is no peril in the house at the Fecafoot.
If there was really urgency, Fifa, as usual, would have taken urgent and drastic precautionary measures to ward off the hurry. Nobody knows the dexterity and rigor with which Fifa is used to reacting to this kind of situation.
Besides, Cameroonians know something about it. In all likelihood, and any measure kept, FIFA would not be very willing to upset the current order of things at the Fecafoot. And everything would even lead to believe that the umbrella body of world football would be on the same wavelength as the Cameroonian government, which through the voice of the head of the ministerial department of sports, had solemnly taken up the cause of president Tombi, on November 18, 2015. And since then, it has been the status quo  in government decision-making bodies.
The Cameroonian head of state, in a double ceremony held at the Unity Palace, had even had to congratulate the football authorities after the good performances realized by the Lionesses at the end of the 2016 Women's AFCON in Cameroon And especially after the fifth consecration of the Indomitable Lions at Gabon 2017 AFCON.
Tombi A Roko had even been decorated. Is there any better proof of giving away someone? At the level of international jurisdictions, the Tombi case has all the appearance of a Kafkaesque trial. It is this kind of trial, unfolded and unsettled, painted by the German writer Franz Kafka in one of his famous works "The Trial". It exposes an inextricable judicial environment, essentially, based on a finicky bureaucracy whose primary vocation was to apply unlimited procrastination.
The aim was to delay as far as possible the expiry of the sentence. The CAS, which in reality is a dismemberment of the Fifa, works in this way in the settlement of the dispute of the Fecafoot. For a long time, the CAS turned the group of dissidents into derision. Is this jurisdictional body, full of experienced jurists, incapable of rendering the sentence that dismisses Tombi and his acolytes? There is no need to speculate on the sex of the angels to know that the pile is shifting and procrastinating in the Fecafoot record. Moreover, the CAS can not row against the decisions taken by the FIFA.
The two entities function in perfect symbiosis. Henceforth aware of the delay in the CAS, dissidents have migrated to another jurisdiction, namely the Swiss Federal Court, to win the case. But it's bluff! Whatever the case, there are always barely veiled bridges between these different jurisdictions.
Good to know, the Pile and the Fifa play on the time factor. Opponents of Tombi must understand this. For the time being, President Tombi is in the best position to carry out his mandate. Reality very difficult to integrate in the opposing camp. Obviously, there is no question of disillusionment. We must certainly continue the fight, but knowing that all this deployment is likely to be a sword in the water ...
